These terms apply to any purchase made on proiacta-montessori.com. Placing an order implies full and unconditional acceptance of these terms.

Payments are processed by Lemon Squeezy, LLC acting as Merchant of Record: that company issues the invoice, collects and remits the VAT due in the buyer's country of residence. The seller remains responsible for the content of the resources, after-sales service, and the personal data collected on this site.

2. Products

Pro-iacta Montessori sells digital educational resources (downloadable PDF files) designed according to Montessori pedagogy, available in French, Spanish and English.

The essential characteristics of each product are described on its presentation page. Visuals are provided for illustrative purposes only.

These resources legally qualify as digital content not supplied on a tangible medium within the meaning of article L221-28 13° of the French Consumer Code, which entails the consequences described in article 7 below.

In addition to these digital resources, Pro-iacta Montessori offers individual accompaniment sessions. These are a distinct service, governed by article 13 of these terms.

3. Prices

Prices are shown in euros (€), inclusive of all charges. VAT is not applicable.

The seller reserves the right to modify prices at any time. The applicable price is the one displayed at the time the order is placed.

4. Order

The order is completed in four steps :

Selection of products in the shop
Entry of the delivery email address
Choice and validation of payment method
Order confirmation (double-click validation)

A confirmation email is sent to the address provided once payment is validated. This email serves as proof of purchase.

5. Payment

Payment is made online in a secure manner. Bank details do not pass through Pro-iacta's servers and are never stored by the seller.

Accepted payment methods : credit/debit card, via Lemon Squeezy (secure payment provider).

6. Delivery of Digital Files

After payment confirmation, the customer receives a secure download link at the email address provided during the order.

If not received, please check your spam folder and contact us. We handle all claims within 48 working hours.

For any claim specifically concerning delivery consolidation (download unavailable, corrupted file, or inaccessible link), the customer has a period of one (1) hour from payment to notify us, ideally attaching proof (receipt or screenshot of the confirmation page). After this period, delivery is presumed to have been completed successfully, unless the customer provides evidence to the contrary. This period applies only to claims relating to the technical delivery of the file; it does not restrict or replace any other claim periods or remedies provided under French consumer law (including the legal conformity guarantee, the consumer mediation referred to in Article 11, or any other applicable mandatory right).

Download access remains available for fifteen (15) calendar days from payment confirmation, with a maximum of three (3) downloads per file. After these limits, access is deactivated. The customer keeps any file already downloaded within that period; if it needs to be recovered after that, they may contact us at the address given in article 10.

7. Right of Withdrawal

In accordance with Article L221-28 13° of the French Consumer Code, the 14-day right of withdrawal does not apply to digital content not provided on a physical medium, once performance has begun with the consumer's prior express agreement.

Before any payment, the customer ticks a dedicated, non-pre-ticked checkbox by which they expressly request immediate access to the content and acknowledge that they thereby waive their right of withdrawal. This acceptance is timestamped and stored with the order.

8. Licence of Use — Educational Digital Resources

The digital resources offered by Pro-iacta Montessori are educational materials intended for personal and direct use. They are designed to be used by the purchaser in a non-commercial educational context — at home or in the classroom — in accordance with the values of Montessori pedagogy.

The purchase grants the buyer a personal, non-exclusive and non-transferable licence to use the acquired file, in accordance with Articles L.122-1 et seq. of the French Intellectual Property Code (Code de la propriété intellectuelle). This licence does not constitute a transfer of intellectual property rights.

The following are strictly prohibited, subject to the penalties set out in Articles L.335-2 et seq. of the French Intellectual Property Code :

Reproducing, duplicating or distributing the file in whole or in part, by any means whatsoever
Sharing the download link or the file with third parties
Modifying, adapting, transforming or creating derivative works for redistribution purposes
Using the content for commercial, professional or institutional purposes without the prior written authorisation of the author
Publishing, broadcasting or disclosing the file on any digital or printed medium

Any violation of this licence may constitute copyright infringement under the French Intellectual Property Code, punishable by up to three years' imprisonment and a fine of €300,000 (art. L.335-2 CPI), without prejudice to any damages the rights holder is entitled to claim.

9. Liability

The resources are intended for educational use at home or in the classroom. They serve as a support tool and do not replace professional educational supervision.

11. Consumer Mediation (membership in progress)

In accordance with Article L612-1 of the French Consumer Code, if a dispute is not resolved after a complaint, the consumer may use a certified consumer mediator free of charge.

In accordance with articles L.616-1 and R.616-1 of the French Consumer Code, any dispute relating to the performance of a distance sales contract may be submitted to mediation. The company is in the process of joining an approved consumer mediation body: the mediator's full details (name, postal address and website) will be published on this page as soon as membership is effective, expected in October 2026. In the meantime, consumers may send any complaint directly to the company, at the email address given in the legal notice.

12. Applicable Law and Jurisdiction

These terms are governed by French law. In case of dispute, the consumer may refer the matter to the court of their place of residence or the place of delivery of the product.

In accordance with article 6 of Regulation (EC) No 593/2008 ("Rome I"), a consumer residing in another European Union Member State retains the benefit of the mandatory consumer-protection provisions of their country of residence. The choice of French law cannot deprive them of that protection: these terms apply within that limit.

13. Accompaniment sessions — cancellation

Accompaniment sessions (in person or by video call) are a service distinct from the digital resources covered by articles 2 to 8 of these terms.

Any cancellation or rescheduling request must be made no later than 48 hours before the scheduled session time. After that deadline, the session is considered as having taken place and remains due, except in duly justified cases of force majeure.
